1. DEFINITIONS
In these terms and conditions, the following definitions apply:
– “Agreement” means these terms and conditions, as amended from time to time.
– “Customer” means the person or entity subscribing to the Planet Automation Care program.
– “Program” means the Planet Automation Care program, which includes the subscription levels and benefits outlined in the program description.
– “Services” means the maintenance, repair, and support services provided by Planet Automation under the program.
– “Subscription Level” means the specific level of service chosen by the customer, as outlined in the program description.
2. SUBSCRIPTION AND PAYMENT TERMS
2.1. The customer agrees to subscribe to the program for a minimum period of 12 months from the date of enrolment.
2.2. The customer shall pay the subscription fees as outlined in the program description, either monthly or annually, via debit order or credit card.
2.3. Payment is due on the first day of each month or year, as applicable.
2.4. If payment is not received within 7 days of the due date, Planet Automation reserves the right to suspend or terminate the customer’s subscription.
3. SERVICES AND BENEFITS
3.1. Planet Automation shall provide the services and benefits outlined in the program description, as applicable to the customer’s subscription level.
3.2. The customer acknowledges that the services and benefits are subject to change, and Planet Automation reserves the right to modify or discontinue any service or benefit at any time.
4. MAINTENANCE AND REPAIRS
4.1. Planet Automation shall provide regular maintenance visits, as outlined in the program description, to ensure the optimal performance of the customer’s garage door and gate motor systems.
4.2. In the event of a breakdown or malfunction, Planet Automation shall provide repair services, as outlined in the program description.
5. TERMINATION AND CANCELLATION
5.1. The customer may terminate or cancel their subscription upon 30 days’ written notice to Planet Automation.
5.2. Planet Automation reserves the right to terminate or cancel the customer’s subscription if the customer fails to pay their subscription fees or breaches any term or condition of this agreement.
6. LIMITATION OF LIABILITY
6.1. Planet Automation shall not be liable for any damages, losses, or expenses arising from or in connection with the program, except to the extent caused by Planet Automation’s gross negligence or wilful misconduct.
6.2. In no event shall Planet Automation’s liability exceed the amount of the subscription fees paid by the customer in the 12 months preceding the event giving rise to the claim.
7. GOVERNING LAW AND JURISDICTION
7.1. This agreement shall be governed by and construed in accordance with the laws of South Africa.
7.2. Any disputes arising out of or in connection with this agreement shall be resolved through arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa.
8. CHANGES TO TERMS AND CONDITIONS
8.1. Planet Automation reserves the right to modify or amend these terms and conditions at any time.
8.2. The customer shall be notified of any changes to the terms and conditions via email or written notice.
9. ACCEPTANCE
9.1. By enrolling in the Planet Automation Care program, the customer acknowledges that they have read, understood, and accepted these terms and conditions.
